1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your use of the Quick Check In Out mobile application (the "App") made by Iconic Apps LLC ("Iconic Apps", "we", "us" or "our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
If you use the App on behalf of a daycare, school, program or other organization (a "Provider"), you confirm that you are authorized to accept these Terms on its behalf.
2. Description of the App
The App lets Providers record when children are checked in and checked out, capture a parent or guardian's signature, review daily attendance and export attendance reports. The App is provided free of charge. All information is stored locally on the device where the App is installed.
3. Provider Responsibilities
As a Provider, you are responsible for:
- Obtaining any notices or consents required from parents or guardians before recording their or their children's information
- Making sure the information entered in the App is accurate
- Complying with all laws, regulations and licensing requirements that apply to your attendance and childcare records
- Keeping the devices that run the App secure, including setting a strong admin PIN and a device passcode
- Controlling who can access the App, the admin PIN and any exported reports
- Keeping your own copies of any records you are required to retain, for example by regularly exporting or printing reports
4. Your Data
Information you enter in the App is stored only on your device. Iconic Apps does not receive, store or back up this information and cannot recover it. Data may be permanently lost if the device is lost, damaged or reset, or if the App is deleted. You are solely responsible for backing up any information you need to keep.

5. Acceptable Use
You agree to:
- Use the App only for its intended purpose of recording attendance
- Not use the App for any illegal or unauthorized purpose
- Not attempt to reverse engineer, decompile, or modify the App
- Not interfere with or disrupt the App's functionality
6. Not a Safety or Emergency System
The App is a record-keeping tool. It is not a child safety, security or emergency system and must not be relied on to track the location or safety of any child. Providers remain fully responsible for the supervision and safe release of children in their care, including confirming the identity and authorization of anyone picking up a child.
7. Disclaimers
The App is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the App will be error-free or uninterrupted, or that records will be complete or accurate, or that the App will satisfy any legal or licensing record-keeping requirement.
8. Limitation of Liability
To the maximum extent permitted by law, Iconic Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, records, profits or use, arising out of or relating to the use of or inability to use the App. This includes losses resulting from lost, inaccurate or incomplete attendance records.
9. Intellectual Property
The App and all related content, including text, graphics, logos, and software, are the property of Iconic Apps and are protected by copyright and other intellectual property laws. Information you enter in the App remains yours.
10. App Store Terms
Your use of the App is also subject to the terms of the app store you downloaded it from, such as Apple's App Store or Google Play. Apple and Google are not parties to these Terms and are not responsible for the App or its support.
11. Termination
You may stop using the App at any time by deleting it. We may stop offering or supporting the App at any time. Deleting the App permanently deletes the information stored in it.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will post the updated Terms on this page and update the "Effective Date" above. Continued use of the App after changes take effect means you accept the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.
