By downloading, installing, or using the TrackIt Metra mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

TrackIt Metra is a mobile application that provides real-time tracking and schedule information for Chicago Metra commuter rail services. The App displays train locations, arrival times, and service updates based on publicly available data.

3. User Responsibilities

As a user of the TrackIt Metra app, you agree to:

• Use the App only for its intended purpose
• Not attempt to reverse engineer, decompile, or modify the App
• Not use the App for any illegal or unauthorized purpose
• Not interfere with or disrupt the App's functionality
• Comply with all applicable laws and regulations
• Use the App responsibly and not rely solely on it for critical travel decisions

4. Transportation Disclaimer

TrackIt Metra is designed to provide information about Metra train services. Users are responsible for:

• Verifying train schedules and arrival times independently
• Following Metra's rules and regulations
• Ensuring they arrive at stations with sufficient time
• Using alternative transportation when necessary
• Checking for service alerts and updates from Metra directly

5. Disclaimers

No Guarantee of Accuracy: While we strive to provide accurate and up-to-date information, we cannot guarantee the accuracy, completeness, or timeliness of train data. Train schedules and real-time information may be subject to delays, cancellations, or changes.

Third-Party Data: The App relies on data provided by Metra and other third-party sources. We are not responsible for the accuracy or availability of this data.

Service Availability: We do not guarantee that the App will be available at all times or that it will be free from errors or interruptions.

6. Limitation of Liability

To the maximum extent permitted by law, Iconic Apps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or relating to the use of the App.

This includes, but is not limited to, damages resulting from missed trains, delayed travel, or any other transportation-related issues.

7. Location Services

The App may request access to your device's location to provide relevant train information for nearby stations. You can disable location services at any time through your device settings. We do not store or transmit your location data to our servers.

8. Intellectual Property

The TrackIt Metra app and all related content, including but not limited to text, graphics, logos, and software, are the property of Iconic Apps and are protected by copyright and other intellectual property laws.

Metra and related trademarks are the property of their respective owners.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the App.

10. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice, effective immediately.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms in the App and updating the "Effective Date" at the top of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.
